Get simplified probate if your Last Will and Testament was prepared by your LegalShield provider law firm, your membership contract is in force on the date of death of the testator, and the estate otherwise qualifies for proceedings that Transfer Assets through the Probate Court without completing a full administration. Covers the estate of you and your spouse only in the state of residence at the time of death. Any costs are not covered. The value of their estate must not exceed the limits allowed in each state and is available only if such a procedure is provided in your state of residence, and the matter is uncontested. In New York, this benefit requires a discounted hourly fee payment for services.

Get legal assistance on non-criminal moving traffic citations received while driving a properly licensed, registered, and insured motor vehicle with the consent of the licensed motor vehicle’s owner. Your membership covers a preset number of moving traffic violations per covered person per membership year. Unused traffic ticket assistance services accrue year after year. See legal plans for the specific number of tickets available as well as maximum accrual amounts. Any accrued time is lost if your membership is canceled or downgraded. Tickets must be submitted to your provider law firm at least five business days before the appearance date. You must attend the court hearing if your lawyer requests it, and there is a fee of $79 when a court appearance is required by the lawyer. This service does not cover out-of-state tickets or matters that won’t adversely impact your driving or motor vehicle record. Pre-existing events, matters involving a vehicle driven for income-producing purposes, misdemeanor or felony charges, and allegations of driving under the influence are excluded. Receive advice, consultation and representation for covered criminal charges of manslaughter, involuntary manslaughter, negligent homicide, or vehicular homicide while driving a properly licensed, registered, and insured motor vehicle with the consent of the licensed motor vehicle’s owner. Pre-existing events and matters involving a vehicle driven for income-producing purposes are excluded. Matters involving hit and run, leaving the scene of an accident, and allegations of driving under the influence of or impaired by the influence of alcohol, intoxicants, controlled substances, chemicals, or medicines, whether prescribed or not, are excluded. Get legal assistance each membership year to help maintain or reinstate a suspended driver’s license. Unused hours roll over each year, up to a maximum of three years. Your LegalShield provider law firm can provide legal assistance per claim for help collecting property damage claims of $5,000 or less when you, your spouse or covered dependents are involved in damages while driving, riding in, or being struck by a motor vehicle. Receive legal defense if you or your spouse are named as a defendant in a covered civil action filed in a state trial-level court or federal district court. You accrue additional trial time and pre-trial time with your provider law firm for each consecutive year of active membership. See legal plans for exact number of hours available. Hours that are not used during the membership year expire and do not roll over to any later membership year.

Pre-existing matters, counterclaims, a claim defense, or legal position that is not likely to prevail in court, class actions, any criminal charge, actions related to IRS, bankruptcy, marriage, separation, annulment, child custody, or other divorce or other domestic related issues, garnishment, appeal, or any other post-judgment relief action, arbitrations, mediations, and administrative proceedings are excluded. Receive legal advice, consultation, negotiations, and representation if you or your spouse are audited by the IRS on your personal income tax return. You get up to 3.5 hours of pre-trial and 10 hours of trial time during the first membership year. You will accrue an additional 10 hours of trial time for each consecutive year you remain a member, up to a total of 50 hours of trial time after 5 years. Trial time only applies when you, your spouse or covered dependents are sued by the IRS or after paying the disputed tax, you sue the IRS. The hours available for IRS legal services are limited to the total number of hours per membership year for all covered persons. IRS legal services start for any tax return originally due on April 15 of the same year as their effective date. IRS actions related to garnishment, attachment, charges of tax fraud, or income tax evasion are not covered. Matters involving or related to trust returns, business/or corporate tax returns, business-related income or matters related not covered even if included in a personal tax return. 24/7/365 access to a provider lawyer if your rights, freedoms or liberties are being denied or threatened. Emergency access is available anytime you are:

• In the presence of a law enforcement officer that may place you under arrest or take away your rights, freedoms or liberties.
• In the presence of an executive branch official who is attempting to take away your children.
• Involved in an automobile or motorcycle accident that results in bodily harm or physical injury.

This service is not for making, posting, obtaining bond, bail, or other security required for release. Phone access provided is subject to conditions imposed by the detaining or questioning authority.
