When "No Dogs Allowed" Runs Into Federal Law

A restaurant hostess waves off a diabetes-alert dog. A gate agent tells a passenger with PTSD that his service dog's paperwork does not meet the airline's rules. For the employee, each moment feels personal. Legally, each one falls under a different law. The Americans with Disabilities Act. The Fair Housing Act. The Air Carrier Access Act. Most employees do not know which law applies or what to do next.

The Issue Is More Common Than Most Brokers Realize

Brokers are hearing about these situations more often because they are happening more often. In FY 2022, disability was the top reason people filed Fair Housing Act complaints. HUD and its state partners received 5,069.1 In 2023, U.S. and foreign airlines reported 49,082 disability-related complaints, a 16 percent jump from the year before.2 Housing and travel are two of the most common flashpoints. Both hit working families directly.

Why This Belongs in a Benefits Conversation

Most employees who use a service animal do not know where to turn. A landlord refuses a reasonable accommodation letter. An airline questions the paperwork at the gate. The employee gets one shot to respond. A short call with a provider lawyer can be the difference between an approved accommodation and a denial that later becomes a formal complaint.

For benefits professionals, these are the reasons to offer a legal plan. Employees can keep their housing, their travel plans and ultimately, their focus at work. Employers can help reduce the risk of a stressed-out employee spending a workday on hold with a housing authority.

What the Law Actually Covers

The three federal laws cover different settings.

  1. The ADA covers businesses and most public spaces.  
  1. The Fair Housing Act covers landlords and HOAs.  
  1. The Air Carrier Access Act covers airlines.  

Each has its own definitions, forms, and timelines. Employees who confuse the three tend to lose the argument even when they are right. That is where a legal plan can earn its keep. The employee brings the notice or the letter to a provider law firm. A lawyer reads it, explains the applicable rights and can draft a letter for what comes next. Employees do not face the moment alone.
