How to handle a breach of contract situation

Thirty-three percent (33%) of all civil court cases are for breach of contract. If you believe an employee, customer, vendor or other party has breached a contract with your business, you should take the following steps.

  • Try to resolve the dispute by speaking with the other party in a firm yet respectful tone
  • If the problem persists, send a formal demand letter that references the contract
  • If you still get no resolution, you may choose to file a lawsuit for breach of contract

A Small Business Plan from LegalShield allows you to have a lawyer help you will all of the above steps. You get unlimited consultation with a business lawyer and they can even write demand letters and make phone calls to settle contract disputes before going filing a lawsuit.

Filing a breach of contract lawsuit

Sometimes, filing a lawsuit is the only way to get the other party to honor their obligations under your contract. Here are the most common breach of contract cases.

  • Failure to deliver goods or services
  • Failure to fully complete a job
  • Failure to pay on time (or at all)
  • Providing inferior goods or services
  • Failure to give proper notice
  • Breach of confidentiality or non-compete clauses

All lawsuits start by filing a formal complaint in the proper court of jurisdiction that references the contract between the parties, the specific breach(s) and the damages you are seeking.

Filing a lawsuit can be stressful. The good news is you can work with an experienced breach of contract litigator to help you file your case correctly and develop winning arguments.

It has helped me review a retreat participant agreement to make sure I am fully covered, and everything is clear for my clients. I also have used it for a dispute with a marketing consultant who would not release files after termination.

Don't Delay: Had to come to the realization, that one day we will die, and didn't have a Will prepared for our adult children to settle our affairs.... We got a quick turn around. All my concerns and questions were professionally answered.

I recently contacted our LegalShield provider firm regarding a real estate question that couldn't be answered by our local real estate agent. The attorney was prompt and detailed in responding.
